By accessing or using SeeMyEquity (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. The Service is operated by Thunderbird Agency, LLC ("Company," "we," "us," or "our").

2. Description of Service

SeeMyEquity is an informational tool that provides Arizona homeowners, renters, and prospective buyers with home value estimates and neighborhood market data derived from comparable closed sales. The Service is provided for informational purposes only and does not constitute a licensed real estate appraisal, broker price opinion, or professional real estate advice.

3. Not a Licensed Real Estate Brokerage

Thunderbird Agency, LLC operates SeeMyEquity as an informational and lead generation platform. SeeMyEquity is not a licensed real estate brokerage or appraisal firm. Nothing on this website should be interpreted as a formal valuation, appraisal, or real estate transaction. Any communication with licensed real estate professionals through or following use of this Service is subject to the terms of those professionals' own licensing and obligations.

4. Accuracy of Information

Home value estimates are based on comparable closed MLS sales data and statistical analysis. They are not guarantees of actual market value. Actual sale prices may vary significantly based on condition, timing, market fluctuations, and factors not captured in our data. We make no representation that any estimate reflects the price at which a property would sell. Always consult a licensed Arizona real estate professional for a formal comparative market analysis (CMA) before making any buying, selling, or financing decisions.

5. User Submissions

By submitting your information through the Service, you:

• Represent that the information you provide is accurate to the best of your knowledge
• Consent to receive a home value report and, if opted in, follow-up communications related to your inquiry
• Acknowledge that your contact information may be used to connect you with a licensed real estate or mortgage professional affiliated with Thunderbird Agency, LLC
• Agree that submitting an address does not create any contractual relationship or obligation on the part of Thunderbird Agency, LLC

6. Communications Consent

By providing your phone number and checking the opt-in box, you expressly consent to receive text messages (SMS) and emails from Thunderbird Agency, LLC and its affiliated real estate and mortgage professionals. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any SMS or emailing support@AgentPowerUps.com.

7. Prohibited Uses

You agree not to use the Service to:

• Submit false, misleading, or fraudulent information
• Scrape, harvest, or collect data from the Service in bulk or via automated means
• Attempt to gain unauthorized access to our systems
• Use the Service for any unlawful purpose
• Interfere with or disrupt the integrity or performance of the Service

8. Intellectual Property

All content on SeeMyEquity, including but not limited to text, design, graphics, data compilations, and the SeeMyEquity name and logo, is the property of Thunderbird Agency, LLC or its licensors and is protected by applicable copyright and trademark laws. MLS data is © Arizona Regional Multiple Listing Service (ARMLS). Unauthorized reproduction or redistribution is prohibited.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUNDERBIRD AGENCY, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED $100.

11. Governing Law

These Terms of Use are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Maricopa County, Arizona.

12. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Updated terms will be posted on this page with a revised "last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the new terms.
